Analysis of possible adaptation of Czech legislation necessary for entry of vehicles of SAE 3 level and higher into operation
Annotation:
The project responds to current and future needs in preparation for the introduction of autonomous road transport in practice. For the smooth introduction of automated vehicles in the various stages of automation into operation, it was necessary to define and prepare a suitable legislative environment. One of the main tools of the analysis was the inspiration in countries where the introduction of autonomous mobility into legislation is at a more advanced stage and on the other hand, it was necessary to take into account the specifics of the Czech legal environment and the obligations of the Czech Republic. It was necessary to examine individual legal institutions and aspects relevant for the introduction of automated vehicles in individual automation levels (from SAE3) into operation and to identify possible alternative solutions for their modification (in relation to the individual automation levels of SAE J3016). Furthermore, to evaluate and justify their classification and relevance according to the different levels of automation of SAE J3016 (from SAE3 upwards) and to identify from these options and justify possible combinations of options for modifying the legal institutes. The least possible interference with the relevant legislation; the ongoing or prospective preparation of European and international standards binding for the Czech Republic; the interest in creating as quickly as possible an optimised and fully competitive legislative environment for the field of autonomous mobility in the Czech Republic, while respecting as far as possible the current systematics of the legislation concerned and respecting the objective limits set by the relevant international treaties to which the Czech Republic is bound, EU regulations or any other international obligations of the Czech Republic. Within the framework of the individual legal institutes and aspects, emphasis should be placed on the examination of the rights and obligations of the individual subjects concerned, both private and public law, and on their change when automated vehicles are introduced into operation in the individual stages of automation.
